Terms of Use

These Terms of Use (“Terms”) govern your access to and use of Howsembly’s websites, software-as-a-service platform, browser extension, applications, and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms.
Eligibility and authority
You must be legally capable of entering into a binding agreement. If you use the Service for a company or other organization, you represent that you have authority to bind that organization to these Terms. In that case, “you” includes both you and the organization.
Accounts and company workspaces
You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account and for users you invite to a company workspace.
Company owners and administrators may control workspace access, content, billing, retention, and deletion. If your account is managed by an organization, that organization may access, modify, export, or delete content associated with its workspace.
You must notify us promptly at hello@howsembly.com if you believe your account or workspace has been accessed without authorization.
Howsembly Capture browser extension
The Howsembly Capture browser extension allows you to record user-initiated browser workflows and create draft process guides. Depending on the features you enable, a capture may include page URLs and titles, visible page content, screenshots, clicked controls, input interactions, and optional narration transcripts.
You are responsible for obtaining any permissions or consents required before capturing, uploading, editing, sharing, or publishing content. You must not use the extension to capture information you are not authorized to access or process.
The extension includes optional tools intended to help obscure sensitive information, including automatic sensitive-field redaction and manual blur regions. These tools may not identify every password, token, financial detail, personal record, confidential item, or other sensitive value. You are responsible for reviewing every captured screenshot and guide before sharing or publishing it.
You may not use Howsembly Capture to secretly monitor individuals, intercept communications, collect credentials, violate privacy rights, bypass access controls, or engage in unlawful surveillance.
License to use the Service
Subject to these Terms and any applicable plan restrictions, Howsembly grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable right to access and use the Service for your internal business or personal purposes.
No ownership rights in the Service are transferred to you. Howsembly and its licensors retain all rights in the Service, including its software, branding, designs, documentation, and related intellectual property.
Acceptable use
- Do not misuse the Service, attempt unauthorized access, bypass security controls, or interfere with other users or systems.
- Do not upload, capture, publish, or distribute unlawful, infringing, deceptive, defamatory, malicious, or harmful content.
- Do not collect or disclose personal, confidential, financial, health, credential, or authentication information without appropriate authorization.
- Do not introduce malware, automated abuse, excessive traffic, or code intended to damage or disrupt the Service.
- Do not reverse engineer, decompile, copy, scrape, resell, sublicense, or commercially exploit the Service except where permitted by law or expressly authorized in writing.
- Do not use the Service to violate another service’s terms, intellectual-property rights, privacy rights, or applicable law.
- Do not misrepresent your identity, affiliation, captured content, or authority to act for another person or organization.
Customer content
You retain ownership of content you submit, upload, capture, or create through the Service (“Customer Content”).
You grant Howsembly a limited, worldwide license to host, store, reproduce, process, transmit, display, and modify Customer Content only as reasonably necessary to provide, secure, maintain, support, and improve the Service. This license ends when the content is deleted from our active systems, subject to reasonable backup, recovery, security, and legal-retention periods.
You represent that you have all rights, permissions, and lawful authority needed to submit and process Customer Content. You are responsible for the accuracy, legality, quality, and appropriateness of Customer Content.
Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you acknowledge the data practices described there.
Third-party services
The Service may depend on or integrate with third-party products, including browsers, cloud hosting providers, payment processors, email providers, analytics tools, speech-recognition services, and other platforms.
Third-party services are governed by their own terms and privacy policies. Howsembly does not control and is not responsible for third-party services, their availability, their security, or changes they make to their products or APIs.
The Howsembly Capture extension may be distributed through the Chrome Web Store, but Google is not responsible for providing, maintaining, supporting, or warranting the Service.
Billing, subscriptions, and trials
Paid plans, usage limits, trial periods, renewal terms, taxes, and prices are presented at signup or in your billing settings. By purchasing a paid plan, you authorize us and our payment processor to charge the applicable fees and taxes.
Unless otherwise stated, subscriptions renew automatically until cancelled. You may cancel through the available billing settings. Cancellation normally takes effect at the end of the current paid billing period.
Fees are non-refundable except where required by law or expressly stated otherwise. Failure to pay may result in restricted functionality, suspension, or termination.
Service changes and availability
We may add, change, suspend, limit, or discontinue features of the Service. We may impose reasonable usage, storage, security, or technical limits.
We may perform maintenance or respond to security incidents without advance notice. We do not guarantee that every feature, integration, browser capability, or third-party service will remain available.
Beta and experimental features
Features identified as beta, preview, experimental, or early access may be incomplete, change without notice, contain errors, or be discontinued. You use these features at your own risk and should not rely on them for critical operations.
The Service is provided “as is”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, COMPLETE, OR FREE OF HARMFUL COMPONENTS, OR THAT AUTOMATIC CAPTURE, REDACTION, TRANSCRIPTION, SCREENSHOT PROCESSING, NOTIFICATIONS, OR THIRD-PARTY INTEGRATIONS WILL ALWAYS OPERATE CORRECTLY.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law.
Use at your own risk
You use the Service at your own risk. You are responsible for reviewing captured guides and screenshots, maintaining appropriate backups, verifying information before relying on it, and maintaining alternate processes for critical company operations.
The Service is not intended to replace professional legal, privacy, security, medical, financial, compliance, or records-management advice.
Guide templates and suggested materials
Howsembly guide templates and other suggested materials are general informational starting points only. They are not professionally validated legal, human resources, medical, safety, regulatory, financial, tax, or compliance advice and are not substitutes for advice from qualified professionals.
You are solely responsible for reviewing, customizing, validating, approving, publishing, maintaining, and using each template for your organization, jurisdiction, industry, workforce, and circumstances. High-risk or regulated activities may require review by qualified legal counsel, licensed professionals, safety specialists, or other subject-matter experts.
Templates may be incomplete, inaccurate, outdated, or unsuitable for your particular requirements. Laws, regulations, standards, industry practices, and third-party products may change. Howsembly does not guarantee that a template complies with any particular law, regulation, contract, certification, or industry standard.
Subject to these Terms, Howsembly grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to copy and customize templates for your organization’s internal use. You may not resell, sublicense, publish as a competing template library, or redistribute the templates independently from the Service without written permission.
An installed template becomes an independent guide in your workspace. Updates to Howsembly’s template catalog will not automatically update previously installed guides. You are responsible for reviewing and maintaining your installed guides.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU ASSUME ALL RISK ARISING FROM YOUR SELECTION, MODIFICATION, PUBLICATION, OR USE OF A TEMPLATE. HOWSEMBLY DISCLAIMS ALL WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, FITNESS, LEGAL COMPLIANCE, SAFETY, OR RESULTS OF ANY TEMPLATE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOWSEMBLY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE FOREGOING, WE ARE NOT LIABLE FOR DATA LOSS, CORRUPTION, UNAUTHORIZED ACCESS, SERVICE OUTAGES, THIRD-PARTY FAILURES, MISSED NOTIFICATIONS, CAPTURE ERRORS, TRANSCRIPTION ERRORS, FAILURE TO IDENTIFY SENSITIVE INFORMATION, OR RELIANCE ON INFORMATION DISPLAYED OR CREATED BY THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO US FOR THE SERVICE DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US $100).
Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Howsembly and its owners, officers, employees, contractors, and affiliates from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from your Customer Content, your use or misuse of the Service, your violation of these Terms, your violation of applicable law, or your infringement of another person’s rights.
Suspension and termination
We may suspend, restrict, or terminate access if you violate these Terms, fail to pay applicable fees, create legal or security risk, misuse the Service, or threaten the operation of the Service.
You may stop using the Service at any time and may cancel or delete your account where that functionality is available. Termination does not automatically entitle you to a refund.
Provisions that by their nature should survive termination will survive, including provisions concerning ownership, Customer Content responsibilities, payment obligations, warranty disclaimers, limitations of liability, indemnity, and governing law.
Governing law and disputes
These Terms are governed by the laws of Canada and the laws of the province or territory in which Howsembly maintains its principal place of business, without regard to conflict-of-law principles.
Any dispute must be brought in the courts located in that province or territory, unless applicable consumer-protection law requires otherwise. Nothing in these Terms limits rights that cannot be waived under applicable law.
Changes to these Terms
We may update these Terms from time to time. We will update the date above when changes are made. If a change is material, we may provide additional notice where reasonably appropriate.
Your continued use of the Service after updated Terms take effect constitutes acceptance of those Terms. If you do not agree to an update, you must stop using the Service.
Entire agreement
These Terms, the Privacy Policy, and any applicable order or plan terms constitute the entire agreement between you and Howsembly concerning the Service and replace prior agreements concerning the same subject matter.
If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of that provision. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or sale of assets.
